Tupelo to take up 'Spice' ban today

TUPELO - By this time Wednesday, the synthetic marijuana known as Spice could be illegal within the city limits.

The City Council is expected to push ahead by two weeks its vote to ban the unregulated intoxicant, placing it on the action agenda

today at City Hall.

If passed, the ordinance would prohibit the sale, purchase, possession or use of the fake pot, which is readily available at area convenience stores and smoke shops.

Unlike most ordinances which go into effect 30 days after passage, this one would become law immediately.

"Kids think it's OK because it's legal," said Ward 5 Councilman Jonny Davis. "But I think it's more dangerous than marijuana because you don't know what's in it or what it'll do to you."

The substance consists of dried herbs sprayed with a synthetic chemical concoction that mimics the effects of marijuana. Many varieties exist, and none of them are regulated by the U.S. government.

Other council members also expressed support for the ban, but Ward 1 Councilman Markel Whittington on Monday questioned the city's ability to police the sale or possession of Spice. He said it'd be too difficult to do.

Police Chief Tony Carleton, who last week had urged its swift passage, told Whittington that his officers would enforce the ban just like they would against any other narcotic.

Any shops that now sell the herbal blend also would be told immediately to stop carrying it. Businesses selling it outside the city limits, however, would not fall under the city's ban.

Violator of the proposed ordinance could face up to $1,000 in fines and six months in jail.

Aren't they fighting a never-ending battle? As soon as they ban one chemical, it seems there are several new ones to replace it. http://www.herbalk2incense.com/ claims to have stuff that is legal in every single state. Are they going to keep banning these substances as they come up? That's going to be costly and as you can see, not so effective.

hey you one sided idiots, especially this rehabku. I could care less what you say. You are on the wrong side of the fence. So what it is bad. Is it bad because YOU say so? Liquor kills more people than anything else we are talking about. I am not for drugs, but if you are going to ban what one person likes, then why not ban what other people like. Tupelo jumps the gun on everything they do. Why? I tell you why. There are a bunch of old people in office that live back in the 70's. Times have changed. Lets get a strip club in Tupelo, oh wait, someone already tried and it was banned. You suck. Jhall2, you go ahead and take that collection up and i will be there to get it. You are pathetic.

I cannot see any fun in smoking spices of any kind. Why is it that in some people's mind "fun" is either drinking or doing other things that cause a high?

Fun used to be family picnics, amusement parks, vacationing on beaches or the mountains, movies etc.

No one's "dying" from this product. Right now it's being sold by responsible vendors who don't sell it to minors. Make it illegal and someone unsavory will make SURE it gets into the hands of anyone willing to pay for it. So once again, Tupelo will make a knee jerk reaction that will help fill the jails with more non violent offenders and fill their coffers with BS fines. That's what it's really about...revenue. Oh and the idea that no one should have any fun, anywhere, unless your idea of fun is the Baptist church box social.

jhall2: You seem like a reasonable person. So, surely you can understand that the only thing that prohibition of a substance does is drive it underground so that the criminals can profit from it and sell it to anyone, including kids.

If the goal is to protect kids, the ban is the worse possible thing that they can do.

If it's to make it more available to kids, then banning it is the best way to do that.

Brewer: You seem to be quick to insult the town and call folks rednecks. But your comments on another story paint you as the stupid person. Do you even know what these spices are???? And the FDAs stance on them are. The so called spice has labels on them that rival labels on poison. And besides that. Gasoline isn't banned. But you can huff it and harm yourself if you're an idiot. You might want your kids or family to be pressured into trying the fake pot. But it can be really dangerous. Fortunately it probably can't killed them but it can easily cause brain damage.

lets start a fund to help brewer get out of this town. everyone please contribute.

People talk about how bad this town is, and I'll agree...the government makes some bad decisions. But cleaning up any drug use (even if its not currently illegal) is a good thing, in my opinion.

I will say my peace on this. This is exactly what is wrong with this town. If the FDA doesn't ban it, then why should it be legal for Tupelo to ban it? You people are a bunch of rednecks. You have no right to ban anything. Everytime that something comes out that some people (not me) can enjoy, there is always a bunch that want to ban it. How about we ban the sale of Liquor to. Hell its worse than anything else. You wont do that though, due to most politicians around here are drunks anyway. This town sucks and i can't wait to get the hell out of here.

Now to the Spice issue.

Please City Council hurry to ban this scourge that is sweeping the city killing our kids!! Please act now before it's too late!!

Wait, you mean that it's only sold in a couple of places and those places don't sell it to anyone under 18?

Maybe they will tack on a ban of being stupid in government buildings. That should fix everything. Buildings will become vacant.

They should crack down hard on this. And stores that sell tings to use with illegal drugs like glass tubes and "tobacco" grinders. Stores like Tobacco Superstore in Tupelo and Amory, they both have those things and have tried to sell the "spices". How can a person buy something from a store when the person can't even have the item in their possession. But that store can sell it. Makes no sense!! And the laws in place for the cigarette ban are even enforced, daily you can see employees in Amory, smoking right at the door. Uhhh thats not 25 ft!!
