They were:
- Anthony Lee Tucker, circuit court of Clay County, 2007 conviction of possession of stolen property. He was sentenced as a habitual offender to 10 years in prison, without possibility of parole, and to pay a $10,000 fine upon release.
- Robert Louis Sanders, circuit court of Lafayette County, 2008 conviction of simple robbery. He was sentenced to 12 years in prison with three years suspended.
- Albert Joiner Jr., circuit court of Lafayette County, 2009 conviction of felony fleeing from law enforcement and strong armed robbery. He was sentenced as a habitual offender to 19 years in prison.
Joiner's motion to the Court of Appeals was for reconsideration of the trial court's denial of his request to vacate his conviction, claiming he was improperly charged and sentenced as a habitual offender. He also claimed that his trial counsel was ineffective.
Voting 9-0, the court affirmed Judge Henry Lackey's decision to deny his request.
The court noted that Joiner originally also was indicted for possession of a deadly weapon by a felon and faced a possible life sentence, but his attorney negotiated a reduced sentence and dismissal of that charge.
