Saltses' new trial awaits state appeal

GREENVILLE - Marie and Michael Salts will not get a new trial yet, with the state appealing a federal judge's recommendation to the 5th Circuit Court of Appeals.

The Saltses were convicted of embezzlement in 2005 in connection with a Prentiss County funeral home they operated. Both were sentenced to prison terms.

Monday, U.S. District Judge W. Allen Pepper Jr. halted the clock on a new trial while the state appeals Pepper's agreement with Magistrate Judge Jerry Davis' report that the couple's rights to a fair trial were denied by ineffective counsel.

Pepper also granted Marie Salts' application for bail while they await more judicial decisions, although he denied her husband bail.

He said Marie, who is on house arrest after a prison term, poses no flight risk, while Michael has another charge pending.
