Judge to hear MIPCO-investor dispute

ABERDEEN - Chancellor Jacqueline Mask will hear both sides March 5 in a dispute about whether arbitration should settle an investor's lawsuit against biodiesel company MIPCO.

Mask this week set the hearing for 9:30 a.m. in the Pontotoc County Chancery Building.

MIPCO, believed to have moved its operations to Aberdeen from Houston recently, is being sued by investor Process Technology Services LLC of North Carolina to get back its $365,000.

PTS claims MIPCO officials lied about their expertise to make biofuels and about their personal financial backing for the company.

The lawsuit was filed Dec. 23 in Monroe County Chancery Court.

Instead of answering PTS' claims directly, MIPCO filed the motion to dismiss Feb. 2, claiming the purchase agreement requires such disputes to go to arbitration.

PTS' response insists a move to arbitration is voluntary and that it doesn't seek that avenue.

PTS also wants interest and attorneys' fees.
