UPDATE: Miss. high court says Gov. can't cut 'court' budget

JACKSON - The Mississippi Supreme Court, in a unanimous ruling, said Friday that Gov. Haley Barbour does not have the constitutional

authority to cut the budget of the state's court system.

Supreme Court Justice William Waller Jr. wrote that the state fiscalofficer could not impose the cuts to the court that Barbour made in January . The governor is making cuts because state tax collections continue to come in below projections.

Waller wrote the governor could not cut the court system because under the state Constitution it is a separate co-equal branch of government.

Good attempt to save money, but valid over-ruling. A change to the court system should require executive and legislative branch involvement and approval.
