A U.S. District Court document, filed Nov. 24, indicates he'd rather have his job back than "front pay."
Last July, a federal court jury agreed Hardy was pushed out of his TPD job after he said a colleague was "persecuted" because of his race. Hardy is white and the colleague is black.
At that time, Hardy did not ask for reinstatement, but rather payment for future wages and benefits that would have been paid had he not been pressured to leave.
"The circumstances precluding reinstatement have ceased to exist," the new motion states, pointing to retirements by the chief of police and a major, whom Hardy insisted brought about his "constructive discharge."
"There is no reason (Hardy) cannot resume his work there," the motion adds.
