Tupelo couple blames railroad for wife's injuries

OXFORD - Helen and Jerry Gable of Tupelo want $6.4 million from Burlington Northern Santa Fe Railway Co. for what they say they've experienced since she was injured near the tracks across Lumpkin Street.

The railroad says it's sorry for her injuries but notes even Helen Gable admits in her own lawsuit that she was trespassing when she went onto the tracks to take photos Oct. 15, 2006.

The lawsuit, originally filed in Circuit Court of Lee County, was moved Friday to U.S. District Court by the railroad company.

The Gables also sued the train's engineer, conductor and up to five unknown people who may have caused or contributed to the incident.

They're asking for $6.43 million, which includes $5 million for Helen Gable's pain and suffering, $326,626 for her medical bills, $361,725 for her loss of earning capacity, as well as $750,000 for Jerry Gable's mental anguish and loss of sexual relations with his wife.

The lawsuit, which is just one side of the story, claims that about 2:30 p.m. that day, Helen Gable was standing on the tracks taking photos of her niece's daughter, then caught her foot in the track slope as she left the railway.

As she did so, a piece of metal "cable, wire or banding" swinging off the train's side hit her, nearly severing her right leg.

The couple insist the railroad and everybody else were negligent, failed to inspect cars and failed to prevent people from getting onto the tracks. They also say the train was going too fast.

They also blame the conductor for not stopping the train to prevent Helen Gable from being injured.

BNSF Railway spokeswoman Suann Lundsberg said the company is investigating and has equipment that detects if something is hanging or dragging from a train.

I guess in theory, you're trespassing every time you cross over a railroad track in your car.

For you stupid people that have no idea what this lady went through you need to get the facts before you judge anyone. She and her whole family went through hell and back. Only God has the right to judge anyone. If it was your family all of you would think differently. Did your mothers not teach you if you have nothing good to say to keep your mouth shut? Just asking.

I kind of wondered what repercussions this might have for the Gables and their family. I would be embarrassed to be connected with people willing to do something so obviously greedy and misguided. I definitely wouldn't hire her to take pictures. She might sue me.

This lady and her husband are VERY sick individuals. People like this are the reason for the downturn in society. Money for nothing!!! GREEDY!!! Unwilling to take responsibility for their own actions. As it is said. "The love of money is the root of all evil" and I would say that for these actions she has to be fairly evil herself.

Helen, I hope you read these comments. People of Lee County should know that this lady is still working taking photographs and has always been greedy as they come. Maybe this article will persuade you to boycott her services if for some reason your child's organization ever needs group or sports photography. This lawsuit is exactly the downfall of the American economy and I don't think Helen's own parents would be proud of her for her greedy actions. 6.5 million dollars? I mean, come on really? You were trespassing. The railroad should charge you a cover for using their tracks as a backdrop for your crappy photos. I am sorry this happened to you; admit your mistake, get a real job, and quit looking for a way to live off the system.

I remember as a kid going on the tracks and placing pennies on the rail or we would just walk the tracks. I knew it was wrong. Thank goodness, I was never maimed or killed for my ignorance. But, I know if I had been, my parents would have never blamed the railroad company for MY STUPIDITY. This is just another get rich quick scam and I hope the justice system wakes up and stops it. This is just one of the pieces of crap the last 25 yrs that has put America on its downward spiral.

What nuts! I hope they lose and lose big. The railroad ought to countersue for punitive damages for these people being so blatantly greedy, not to mention frivolous in filing this lawsuit. I thought our mothers taught us when we were little to stay off of railroad tracks for the very reason that you might get hurt or killed. Um, and how does getting your leg cut off hinder your capacity to have sex? Last time I checked, and I'm pretty familiar with the procedure, you could have no legs and still get it on. This is what our court system is reduced to wasting money and resources on. For shame.
