UPDATE: Judge says no to new trial for city of Tupelo in Hardy case

TUPELO – U.S. District Judge Sharion Aycock today denied the City of Tupelo a new trial but adjusted the financial award in former police Capt. Cliff Hardy's lawsuit.

Hardy won a jury verdict last July after a week-long trial in Aberdeen.

He contended he was pushed out of his job because of his public statements in support of colleague Robert Hall. Hardy is white and Hall is black.

Aycock's 41-page ruling retained the jury's $200,000 award to Hardy to compensate him for mental anguish.

But she reduced the $100,000 back-pay award to $85,415 to subtract retirement benefits he'd received.

Both parties have 15 days to file objections with the court.
